## Tampa Golf Cart Accident Lawyers for Neighborhood and Roadway Crashes

Golf carts have become everyday transportation in many Tampa Bay communities. They are also open-sided and usually lack seat belts, so even a slow crash can cause serious injury. These cases raise unusual questions about who is responsible and which insurance applies, and that is where we help.

## Golf Carts Have Become Everyday Transportation

In many Tampa Bay communities, a golf cart is how people get to the pool, the clubhouse, a neighbor's house or nearby shops. You will see them in places like Carrollwood Village, Starkey Ranch, FishHawk Ranch and Sun City Center, in Wesley Chapel's master-planned neighborhoods, and in Spring Hill-area communities like Timber Pines.

Florida regulates golf carts under section 316.212. In general, they may be driven only on roads a county or city has designated for golf cart use, plus limited crossings, and only in daylight unless the local government allows night use and the cart has the required lights and equipment. Local governments and homeowners associations add their own rules, so what is allowed varies from one community to the next. Low-speed vehicles (LSVs) look similar but are built to different standards, and they are titled, registered and insured more like cars.

## Why Golf Cart Crashes Are So Serious

Golf carts have no doors, no airbags and often no seat belts. Riders sit exposed, so a sharp turn, a curb or a slope can throw them out or tip the cart.

Common golf cart accidents include:

- Rollovers on turns, slopes, curbs and the banks of retention ponds
- Ejections, often of children or passengers riding on the back
- Collisions with cars at road crossings and neighborhood intersections
- Pedestrian and cyclist strikes on shared paths
- Equipment failures involving brakes, steering or worn tires, especially on rental carts

Injuries range from fractures and facial injuries to traumatic brain injuries, spinal cord injuries and, in the worst cases, death.

## Underage Drivers and Owner Responsibility

In some neighborhoods it is common to see kids at the wheel. Florida law sets age and licensing requirements for driving a golf cart on public roads, and a young or inexperienced driver raises serious questions about who allowed them to drive.

Florida courts have also treated golf carts as "dangerous instrumentalities." In practical terms, an owner can be held responsible when someone they allow to use the cart causes a crash, even if the owner was not there. Owners and parents who hand the keys to an unfit driver may also face negligent entrustment claims.

## Rentals, Resorts, Courses and HOAs

Golf cart rental businesses, resorts and golf courses must maintain their carts and operate safely. A rental cart with bad brakes, a course path with a dangerous drop-off, or a community path with poor lighting or design can shift responsibility to the business or association in charge. Waivers signed at the rental counter have limits and do not automatically end a claim.

## Sorting Out the Insurance

Insurance is often the hardest part of a golf cart case. Florida does not require standard golf carts to carry the auto coverage required for cars, so payment may come from several places:

- A separate golf cart policy, if the owner bought one
- A homeowner's policy, which may or may not cover a cart, depending on its terms and where the crash happened
- The driver's auto liability coverage, when a car is involved (PIP may not apply to people riding in a standard golf cart)
- Your own uninsured motorist coverage, in some situations
- The liability coverage of a rental business, resort, course or HOA

Whether any of these applies depends on the actual policy language. We request and read the policies rather than taking an adjuster's word for what is or isn't covered.

## What to Do After a Golf Cart Accident

- Call 911 and get medical care.
- Report the crash to law enforcement.
- Photograph the cart, the path or road, any slopes or signs, and your injuries.
- Find out who owned the cart and who was driving.
- Get insurance information from everyone involved, including any rental business.
- Ask about community security or gate cameras, since footage may be erased quickly.
- Don't allow the cart to be repaired or returned before it is documented.

## How We Help

We investigate how the crash happened, identify the owner, the driver and any business or association involved, review local rules and HOA requirements, and track down every policy that might apply. Under Florida's modified comparative negligence rule (section 768.81), any share of fault assigned to you reduces your recovery, and you generally cannot recover if you are found more than 50% at fault, so we work to make sure fault is assigned fairly.

Most golf cart injury claims must be filed within two years, and exceptions can shorten that time. If a crash took the life of someone you love, we can also help your family with a wrongful death claim.

## Frequently Asked Questions

Who pays after a golf cart accident?

It depends on the facts. If a car was involved, the driver's auto liability coverage usually comes into play, although PIP may not cover people riding in a standard golf cart. If only golf carts were involved, payment may come from a golf cart policy, a homeowner's policy, a business's liability coverage or the at-fault person directly, depending on the policy terms.

Can the owner be responsible if someone else was driving?

Often, yes. Florida courts have treated golf carts as dangerous instrumentalities, so an owner can be held responsible when someone they allowed to use the cart causes a crash.

My child was hurt in a friend's golf cart. What should we do?

Get medical care first, then write down who owned the cart, who was driving and where it happened. A homeowner's or golf cart policy may be involved. Call us before talking with an insurer about what happened.

Are golf carts street legal in Florida?

Only in limited ways. Under section 316.212, golf carts may generally be driven only on roads that a county or city has designated for golf cart use, and local rules vary. Low-speed vehicles follow different rules.

How long do I have to file a golf cart accident claim?

Most injury claims in Florida must be filed within two years. Some deadlines are shorter, so speak with a lawyer soon after the crash.
